Travel contract

According to the General Law of Defense of the Costumers and Users, and other complementary laws such as the Law of Services of the Information Society and electronic commerce, the first one approved by Legislative Royal Decree 1/2007 of December 16th, the second regarding the Law 34/2002 of July 11th, of services of the information society and electronic commerce, hereinafter we state the General Conditions and other Regulations in force, this agreement is formalized between the travel agency – tour operator Garnata Tours, commercial name property of the company Garnatalia SL, with registered office at Camino de  Ronda 53 2ªC (oficina 6 ) 18004 Granada. C.I.F. [Fiscal Id.]: B-19506146.

Under the terms of the offer specified therein, with the general conditions listed on the basis of the Law 1/2007, also in the program/brochure/Web Catalog which are incorporated to the present contract signed by both parties and the particular conditions detailed here below.

If this minimum is not reached or due to any cause of force majeure, the organizer has the right to cancel the trip until what was stated in the cancellation policy of the particular product days before the trip’s departure date.
 
If no cancellation policy is stated, the product/service/trip shall be applied according to the clauses stated in our general conditions. All of it being communicated to the Client or Clients in advance as established by Law.

* If there is an “essentials” section included in the product, it shall be binding for the realization of the activity/program/service.
All the rest shall be recommendations made for an optimal realization of the activity but shall not be binding.
9.- The Organizer’s representative at destination: the one who appears in the documentation provided to the client before the trip’s departure date. In its case, the Emergency’s telephone No. that appears in our general conditions.
10.- Cession of the reservation:
1. The main contractor or the beneficiary may transfer free of charge his/her reservation in the combined trip to a person who meets all the conditions required thereto.
2. The cession shall be communicated in writing to the agency or, in its case, to the organizer at least 15 days before the trip’s start date, except the parties agree a shorter period in the contract.
3. The person who transfers his/her reservation in the combined trip and the assignee shall be jointly responsible, before the agency or, in its case, the organizer who are part of the contract, for the payment of the price amount, as well as for the justified additional expenses that cession might have caused.
The assignor (main contractor or beneficiary) and the assignee (the third party who shall enjoy the trip), shall be jointly and severally responsible before the Travel Agency and the organizer of the payment of the rest of the price, as well as for the expenses arisen from this cession.
11.- Price: The Total Price of the Trip/Tourist Service (Taxes included)
 
The price has been calculated according to the exchange rates, transportation fees, fuels costs and fees and taxes applicable at the date of the edition of the offer.
Any increase of the aforementioned elements may cause the revision of the final price of the trip, on the strict amounts of the mentioned price changes. The rising revision of prices may be done maximum 20 days before the date of starting the trip/service/tourist activity.
These modifications shall be communicated to the contracting part in writing or by any means that allows to record of its receipt by the addressee.
12.- The price of the trip or tourist service includes: Include section “it includes”
 
•    Tourist Services Management costs, depending on the amount to be paid, the expenses would be as follows: from 10 to 30 euros (VAT INCLUDED): 5 euros (VAT INCLUDED) / From 30 to 300 euros (VAT INCLUDED): 15 euros (VAT INCLUDED) / More than 300 euros (VAT INCLUDED): 25 Euros (VAT INCLUDED).
•    Combined Trips Management costs: 50 euros (VAT INCLUDED).
•    Cancellation fees: 20 euros (VAT INCLUDE).

13.- Modes of payment:

THE PAYMENT OF THE TOTAL PRICE of the combined trip has been done in the web of the Travel Agency against the provision of bonus and the final documentation of the trip, by the signing of this agreement.
14.- Reservation confirmation deadline by the Travel Agency: by the signature of the present contract the trip reservation confirmation has been completed.
15.- Consumer’s withdrawal: At all times, the user or consumer can cancel the contracted services, having the right to be refunded the amounts he/she had paid, either for the total price and the down payment, but shall have to compensate the Agency for the concepts listed below:
ONLINE SERVICES:
1.    In case of single services: all management costs, plus the cancellation costs, if incurred into.
2.    In case of combined trips, and except cancellation is due to force majeure causes:
•    Management costs: 
•    Tourist Services management costs, depending on the amount to be paid, the expenses would be as follows: From 10 to 30 euros (VAT INCLUDED): 5 euros (VAT INCLUDED) / From 30 to 300 euros (VAT INCLUDED): 15 euros (VAT INCLUDED) / More than 300 euros (VAT INCLUDED): 25 Euros (VAT INCLUDED). 
•    Combined Trips management costs: 50 euros (VAT INCLUDED).
•    Cancellation fees: 20 euros (VAT INCLUDED).
•    A penalization, consisting in the 5% of the total amount of the trip if the withdrawal occurs with more than ten working days and fifteen calendar days before the date the trip starts; the 15% between the days 3 and 10, and the 25% within the previous 48 hours. If clients do not appear at the departure hour they shall not be returned any amount paid, unless the parties agree otherwise.
Special conditions: in the event that any of the contracted and cancelled services were subject to contract economic special conditions, such as charter of planes, ships, special rates, etc., the cancellation fees for withdrawal shall be established in accordance with the terms agreed between the parties.
The cancellation produced the same day or the non-presentation to the departure shall not determine any right to refund of the paid amount. It shall generate expenses for the 100% of the total amount of reservation
16.- Claims: 

Reimbursement of amounts received by the employer.

When the consumer and user has exercised the right to withdrawal, the employer shall reimburse the amounts paid by the consumer and user without deducting costs. The repayment of these amounts shall be done without undue delays and, in any case, within the first 14 calendar days after being informed about the decision of withdrawal from the contract by the consumer and user.
After this period without the consumer and user having recovered the due amount, he/she shall have the right to claim it duplicated, without affecting the possible compensations for damages caused in excess of this amount
The employer is responsible to prove the accomplishment of the deadline.
17.- Action prescription: The actions derived from the rights granted to consumers shall prescribe after two years from the day the trip should have finished.
19.- Travel insurance: In case it is not included in the section “includes”, the client can underwrite an insurance contract, to be paid by him/her, which covers the expenses of cancellation by the consumer as well as an assistance contract to cover the expenses of repatriation or transfer to the place of origin in case of accident, illness or death. To underwrite this insurance please contact with the agency.
The data of the Insurance Company and the insurance’s general conditions shall be sent by email once formalized via telephone or email.
20.- Geographic arear of risk: in addition to the information provided by the Agency, the consumer is informed that the Ministry of Foreign Affairs provides information about the specific recommendations depending on the destination through Internet (http://www.mae.es) or by any other means.
